Uber/Lyft Insurance Rules

The “Last Mile” is the Most Dangerous

The Aventura Brightline Station was designed to reduce traffic, but it has created a new hazard: the “Last Mile” scramble. Hundreds of Ubers and Lyfts converge on the station every hour to drop off commuters.

Drivers are glued to their GPS apps, trying to find the correct entrance on **West Dixie Highway**, often making illegal U-turns or stopping abruptly in traffic lanes. If you were injured as a passenger in a rideshare, or if you were hit by one while walking to the station, you have a complex legal battle ahead. At Fenstersheib Law Group, we know exactly how to trigger the $1 Million insurance policies these companies try to hide.

Hazards at the Aventura Station Hub

The “Drop-Off” Zone

The Danger: Chaos. Cars double-parking, doors opening into traffic, and passengers running across lanes with luggage to catch a departing train.

West Dixie Highway Entrance

The Danger: Confusing signage leads to sudden stops. Drivers missing the entrance often slam on their brakes, causing rear-end chain reactions.

Station Premises (Slip & Fall)

The Danger: While the station is new, smooth floors can be slippery when wet from rain or spills. Brightline has a duty to keep the walking surfaces safe.

Unlocking the $1 Million Policy

Rideshare cases are defined by “Periods.” Knowing which period the driver was in determines how much money is available for your recovery.

  • Period 1 (App Off): The driver is just a regular person. We pursue their personal auto insurance (often low limits).
  • Period 2 (App On, Waiting for Ride): Limited commercial coverage applies (usually $50k/$100k).
  • Period 3 (Passenger in Car OR En Route): This is the “Golden Ticket.” Uber/Lyft provides a $1 Million liability policy. If you are injured during this time, we can pursue significant damages.

Proof is Key: We immediately request the “Ride Data Log” from the rideshare company to prove exactly when the app was on and when the ride was accepted.

Station & Rideshare FAQs

I was running to catch the train and tripped. Can I sue?
It depends. If you tripped over your own feet, no. But if you tripped because of a defect—like a loose floor mat, a liquid spill, or broken pavement—Brightline is liable for maintaining a safe premises.
The Uber driver says it wasn’t his fault. Does that matter?
As a passenger, you are almost never at fault. If the Uber driver was not at fault, we sue the driver who hit you. If that driver is uninsured, the Uber policy’s “Uninsured Motorist” coverage may kick in. You are protected either way.
Do I need a lawyer or can I just use the app to report it?
Do not rely on the app. The app is designed to protect the company, not you. They will try to settle your claim for a small credit or low cash offer. Call a lawyer before you click “Submit” on any accident report.
